Re: Cease and Desist – Trademark Infringement

 

To Whom It May Concern:

 

In the event that it comes to our attention that any unauthorized individual is currently using any of our original work in connection with short courses and other educational materials, we make take legal action to solve this matter. Any organization or business which trademark is the same as / similar to our trademark, will be considered to have infringed our trademark and therefore could be prosecuted. In such scenario, we acknowledge that such trademark infringement may inevitably cause confusion for our intended end-users as to the source/origin of the products and services may no longer be clearly identified.

 

We are owners of the trademark, whether our course materials or any components of our brand such as our logo design, and etc. We have used our trademark as early as August 2017, establishing our priority in the trademark. Our company is registered with the CIPC, registration number 2018290565, issued on 28th, May 2018. We have used our trademark for the design and development of our websites and educational materials mainly in Cape Town. Consequently, we aim to prevent the use of the same or similar trademark as any similarity in the design or development and usage of the identical trademark is likely to cause confusion and mistake among our consumers. Therefore each and every unauthorized use of our trademark constitutes trademark infringement.

 

In that effect, PhilTech Enterprises hereby demand that any organization or business unlawfully using our proprietary work cease and desist from using any trademark which is the same or identical to ours. If you do not cease and desist the infringing activity after reading this letter, we will be forced to take appropriate legal action against you and we will seek all available damages and remedies.
